Merchant / Seller Agreement
Your responsibilities as the seller in your Tocler stores: legal goods, payments, taxes, buyers, records and cooperation.
What changed — applies from 3 November 2026
New: your responsibilities as the seller — legal goods with a lawful origin, your own payment accounts, taxes, buyers, refunds and cooperation with checks.
This Merchant / Seller Agreement is part of the Terms of Service. It sets out what you, as the seller in your Tocler stores, are responsible for. Tocler is operated by Tocler, an individual developer (not a registered company) and provides the software only.
1. You are the seller
Every sale in your stores is a contract between you and your buyer. You set the products, descriptions, prices, product terms, delivery and support. Tocler is not a party to that sale and does not take ownership of, hold or resell your goods.
2. Only legal, legitimate goods
You confirm, for every product you list and every key or code you upload, that:
- you obtained it lawfully from the publisher, an authorised distributor or another legitimate source, and you can show where it came from if asked;
- you have every right needed to sell it to your buyers in their country;
- it is not stolen, fraudulently obtained, charged-back, "carded", hacked, cracked, leaked, counterfeit or infringing;
- it works as described, and its description (platform, region, edition, restrictions, age rating) is accurate;
- it is allowed under the Acceptable Use Policy.
You must keep records of where your stock comes from (for example supplier invoices) for at least the time the law requires, and provide them to Tocler on request within 7 days.
3. Payments
- Card payments in your stores are paid into your own account with the card payment provider you connect in Dashboard → Payments. You contract with that provider directly, accept its terms and complete any identity or business checks (KYC) it requires.
- Crypto payments are paid into your own crypto payment account when you connect one; otherwise, where Tocler offers it, through Tocler's crypto account, with your share credited to your Tocler wallet (see Payments, Fees & Payouts).
- You must not ask buyers to pay outside your store's checkout, and must not use your stores to receive money for anything other than the goods listed.
- Tocler's fee on your sales and how it is collected are described in Payments, Fees & Payouts. You agree that owed fees may be taken from your Tocler wallet balance and that unpaid fee invoices may lead to restricted checkout or suspension.
4. Buyers, refunds and disputes
You handle your buyers' questions, complaints, refunds and disputes fairly and within a reasonable time, following the Refund & Cancellation Policy and the terms you showed on the product. You keep the promises in your product terms; Tocler keeps a record of the terms a buyer agreed to at the time of purchase. Buyers may report problems or appeal to Tocler, and Tocler may review the facts it holds (order, delivery, key reveal, product terms) and act on your account if you do not respect your own terms or the law.
5. Taxes and records
You are responsible for the taxes on your sales and income, for registering where the law requires, and for any invoices or receipts the law requires you to give your buyers. Tocler's records in your Dashboard (orders, fees, payouts) can be exported to help you.
6. Compliance, anti-money-laundering and sanctions
You must not use Tocler to launder money, finance illegal activity, evade sanctions or move money for others. You will follow the AML & Compliance Notice, answer reasonable compliance questions from Tocler, and provide the minimum information requested for features that need it (for example direct crypto payments to your own wallets). Tocler may refuse, limit or stop a feature, hold balances it holds and report suspicious activity where the law requires or allows.
7. Your team
Team members act on your behalf. You are responsible for what they do and must give them only the access they need.
8. Enforcement
If you break this agreement Tocler may — depending on the seriousness — ask you to fix a listing, hold or block products, switch off payment methods, pause stores, hold any balance Tocler holds while investigating, refund affected buyers from that balance, close the account immediately and report illegal activity to payment providers and the authorities. For prohibited goods (section 2) the account is closed immediately.
9. Changes and contact
Changes follow section 15 of the Terms of Service. Questions: support@tocler.com.
